Terms of Service

These Terms set out the rules for using this website and buying products from us, including how orders, payment, delivery, returns and complaints work. Please read them before placing an order. If you buy as a consumer, nothing in these Terms limits the rights you have under mandatory consumer protection law.
1. General information
- This online shop (the Shop) is run by the seller (we, us) whose full details β name, address and tax ID β are given in section 18.
- You can contact us by email at support@awkwarduncle.com or through the contact form on the website.
- These Terms are available free of charge on this page at all times, so you can read, save and print them before placing an order. The version in force on the day you place an order applies to that order.
- These Terms are written in English. Before the contract is concluded you can ask us any questions about them by email.
2. Definitions
- Customer (you) β a person who uses the Shop or places an order.
- Consumer β a natural person buying for purposes not directly related to their business or profession.
- Sole trader with consumer rights β a natural person running a business who buys a product directly related to that business, where the purchase is not of a professional nature for them (in particular in light of the business activities they have registered). They have the consumer rights described in section 12.
- Product β an item offered for sale in the Shop.
- Order β your offer to buy Products, made through the Shop.
- Contract β the sales contract between you and us, concluded at a distance via the Shop.
- Account β an optional customer account in the Shop, protected by an email address and password.
3. Using the website
- Through the website we provide the following electronic services, free of charge:
- browsing Products and placing Orders,
- the customer Account (see section 4),
- the contact form, which lets you send us a message.
- Browsing the Shop and sending a message through the contact form are provided for the time you use them and end when you leave the page or send the message.
- To use the Shop you need a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active email address. Payment is made on Stripe's secure checkout page.
- You must not provide unlawful content or use the Shop in a way that breaks the law, infringes the rights of others or disrupts the Shop, for example by attempting to access it without authorisation, overloading it or sending spam.
- As with any service on the internet, there are risks such as malware or phishing. Use up-to-date software and never share your password. We will never ask you for your password or card details by email.
- You can report problems with the website or our electronic services by email to support@awkwarduncle.com. We will reply within 14 days.
4. Customer account
- Creating an Account is free and optional. You can place an Order without one.
- To create an Account you give your email address and set a password. The Account lets you log in and see your order history.
- The Account agreement is concluded for an indefinite period when the Account is created. You can end it at any time, free of charge and without giving a reason, by asking us by email to delete your Account.
- Keep your login details confidential. You are responsible for activity under your Account that results from you sharing your password.
- If you seriously or persistently break section 3(4) of these Terms, we may end the Account agreement with 7 days' notice sent by email, stating the reason. Orders you have already placed are not affected.
5. Products and prices
- Product pages describe the main characteristics of each Product, including its material, size and any safety information. Please read them before ordering.
- Product photos are intended to show the Products as accurately as possible, but small differences in appearance may occur. Colours on screen may look slightly different depending on your display settings.
- Prices are shown next to each Product in the currency displayed. They are final prices and include all applicable taxes. Delivery to the countries listed in section 8 is free, so the price shown at checkout is the total you pay.
- Some Products can be bought in bundles at a lower price per item. The bundle price is shown before you place the Order.
- The price that applies to your Order is the one shown when you place it. Price changes after that do not affect your Order.
- Information on the website is an invitation to conclude a contract, not an offer within the meaning of the Polish Civil Code.
6. Placing an order
- To place an Order:
- choose the Product, its variant and quantity or bundle on the product page,
- click Buy now β you will be taken to Stripe's secure checkout page,
- enter your email address, phone number and delivery address,
- choose a payment method, check the Order summary, and confirm the Order with the button that indicates an obligation to pay.
- Until you confirm the Order on the checkout page you can go back, change your choices or correct your details.
- Placing an Order is an offer to buy the selected Products. The Contract is concluded when your payment is confirmed. We will then send you an order confirmation by email with your order number, the details of your Order and a link to these Terms.
- If, in exceptional cases, we cannot fulfil your Order (for example because the Product has become unavailable), we will tell you by email without delay and refund the full amount you paid within 14 days at the latest, using the same payment method.
- You must be at least 18 years old to place an Order, or have the consent of a parent or legal guardian.
- Please make sure your contact and delivery details are correct. If you notice a mistake after placing an Order, email us as soon as possible β we will try to correct it before the parcel is dispatched.
7. Payment
- Payments are processed by Stripe. On the checkout page you can choose from the following methods, where they are available for your country and the currency of your Order: payment card, BLIK, PayPal, Klarna, Link and US bank account.
- Payment is made in advance: your Order is processed once the payment is confirmed. Some methods (for example US bank account payments) can take longer to be confirmed β we will process your Order once we receive the confirmation.
- If you choose a deferred or instalment payment (for example Klarna), that service is provided by the payment provider under its own terms.
- We never see or store your full card or bank details.
- We issue proof of purchase as required by law. If you need an invoice for your business, email us with your order number and company details.
8. Delivery
- We currently deliver to Poland, the United States, Germany, Czechia, Portugal and Slovakia. Delivery is free.
- Orders are usually processed and handed over for shipping within 24 hours of payment confirmation. Delivery then usually takes 3β25 days, depending on your location. The estimated delivery time is shown on the product page.
- We will deliver your Order no later than 30 days after the Contract is concluded. If we do not deliver on time, you can set us an additional, reasonable deadline; if we miss that too, you can withdraw from the Contract and get a full refund. You can withdraw straight away, without setting an additional deadline, if delivery by a certain date was essential and we both knew this when the Contract was concluded.
- Products are shipped by our fulfilment partner and may be dispatched from warehouses outside the European Union. The price you pay includes import taxes and duties, so you will not be asked to pay anything extra on delivery.
- If you order several Products, they may arrive in separate parcels.
- Please check your parcel on delivery. If it is damaged, we recommend that you ask the courier to write a damage report and contact us β this helps us resolve the matter quickly, but it is not a condition of your rights under section 10.
- The risk of loss of or damage to the Products passes to you when you, or a person you have indicated (other than the carrier), take possession of them.
9. Right of withdrawal (returns)
- If you are a consumer (or a sole trader with consumer rights), you can withdraw from the Contract within 14 days without giving any reason.
- The withdrawal period ends 14 days after the day on which you, or a person you have indicated (other than the carrier), take possession of the Products. If you ordered several Products delivered separately, it ends 14 days after you take possession of the last one.
- To withdraw, send us a clear statement of your decision by email to support@awkwarduncle.com, for example using the model withdrawal form below. Using the form is optional. To meet the deadline it is enough to send your statement before the withdrawal period ends. We will confirm receipt of your statement by email without delay.
- After withdrawing, send the Products back to the return address we give you in our email confirming receipt of your withdrawal statement without undue delay and no later than 14 days after the day you told us about your withdrawal. The deadline is met if you send the Products before it ends.
- You pay the direct cost of returning the Products.
- We will refund all payments received from you, including the cost of delivery (if you paid for it), without undue delay and no later than 14 days after we receive your withdrawal statement. If you chose a delivery method more expensive than the cheapest standard delivery we offer, we do not have to refund the extra cost.
- We will refund you using the same payment method you used, unless you have expressly agreed to another method that does not cost you anything. We may withhold the refund until we have received the Products back or you have provided proof of sending them, whichever is earlier.
- You are liable for any diminished value of the Products resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning β handle them as you would in a shop. Costumes and masks that have been worn, for example at a party, may lose value.
- The right of withdrawal does not apply in the cases listed in art. 38 of the Polish Consumer Rights Act β for example, Products made to your specifications, or sealed Products which are not suitable for return for health protection or hygiene reasons once unsealed after delivery. If any of these exceptions applies to a Product, we will say so clearly on its product page before you order.
10. Complaints and faulty products
- We are responsible for making sure the Products conform to the Contract. If you are a consumer (or a sole trader with consumer rights), we are liable for any lack of conformity that exists when the Product is delivered and becomes apparent within 2 years of delivery, under the Polish Consumer Rights Act.
- If a Product does not conform to the Contract, you can ask us to repair or replace it. If repair or replacement is impossible, would cost us disproportionately much, or we have refused or failed to do it, or the lack of conformity persists or is so serious that it justifies it straight away, you can ask for a price reduction or withdraw from the Contract. You cannot withdraw from the Contract if the lack of conformity is minor.
- To make a complaint, email us at support@awkwarduncle.com with your order number, a description of the problem (photos help) and what you would like us to do. A complaint can also be sent by post to our address in section 18.
- We will reply to your complaint within 14 days of receiving it. If we do not reply in time, your complaint is considered accepted.
- If we need the Product back to deal with the complaint, we will tell you how to send it and cover the cost. We will also cover the cost of repair or replacement, including delivery.
- Normal wear and tear and damage caused by improper use (for example ignoring the care or safety information on the product page) are not a lack of conformity.
11. Out-of-court dispute resolution
If you are a consumer and we cannot resolve a problem together, you can use free out-of-court ways of resolving complaints and disputes, for example:
- help from a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentΓ³w) or a consumer organisation such as the Federacja KonsumentΓ³w,
- mediation or a permanent consumer arbitration court at the Voivodeship Inspectorate of the Trade Inspection (WojewΓ³dzki Inspektorat Inspekcji Handlowej),
- if you live in another EU country β the European Consumer Centre in your country, which helps with cross-border disputes.
More information and a list of bodies are available on the website of the Polish Office of Competition and Consumer Protection (UOKiK): polubowne.uokik.gov.pl. Using these procedures is voluntary for both sides and does not affect your right to go to court.
12. Business customers
- A sole trader with consumer rights (see section 2) has the same rights as a consumer regarding the right of withdrawal (section 9), complaints about faulty Products (section 10) and protection against unfair contract terms.
- For other business customers, liability under the statutory warranty for defects (rΔkojmia) under the Polish Civil Code is excluded to the extent permitted by law. We will still deal with complaints about faulty Products in good faith.
- For other business customers, our total liability under a Contract is limited to the price paid for that Order and does not include lost profits. This does not apply to damage caused intentionally.
13. Liability
- Our liability to consumers is governed by the law, and nothing in these Terms excludes or limits it where the law does not allow us to.
- We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, strikes, carrier or customs delays, or outages of third-party services. This does not affect your rights under section 8(3), section 9 or section 10.
- We take care to keep the website available and secure, but we may need to interrupt it temporarily for maintenance or updates.
14. Intellectual property
The content of the website β including texts, photos, graphics, logos and the layout β is protected by copyright and other laws. You may not copy or use it commercially without our prior written consent, except where the law allows it.
15. Personal data
We process personal data as described in our Privacy Policy.
16. Changes to these Terms
- We may change these Terms for important reasons, such as changes in the law, in our services, in payment or delivery methods, or to improve security.
- Changes do not affect Orders placed before they come into force β those are governed by the version in force when the Order was placed.
- If you have an Account, we will email you about changes at least 14 days before they come into force. If you do not accept them, you can end the Account agreement at any time before then by asking us to delete your Account.
17. Governing law and jurisdiction
- These Terms and Contracts concluded through the Shop are governed by Polish law.
- If you are a consumer living in another EU country, this choice of law does not deprive you of the protection given to you by the mandatory provisions of the law of the country where you live.
- A consumer may bring a claim in the courts of the country where they live or where we have our registered address. Disputes with other business customers will be resolved by the court competent for our registered address.
- If any provision of these Terms is found invalid, the remaining provisions stay in force.
